Дослідження криміналістичної характеристики кримінальних правопорушень в сучасний період вказує на різні підходи у її визначенні та структурі. Хоча місце в структурі методики розслідування кримінальних правопорушень є встановленим в попередніх дослідженнях, а важливість не викликає сумнівів. Саме тому дана стаття включає в себе проблему формування та ролі криміналістичної характеристики щодо організації ухилення від сплати податків, зборів (обовʼязкових платежів). Окремим напрямом в даній статті стало встановлення структури криміналістичної характеристики на прикладі ухилення від сплати податків, зборів (обовʼязкових платежів).
Під час цього дослідження автор намагався надати авторське визначення криміналістичної характеристики, виявивши та включивши обовʼязкові її ознаки. Крім того, проаналізувавши наявні підходи у структурі криміналістичної характеристики окремих кримінальних правопорушень, автор вказав на наявність обовʼязкових та додаткових елементів таких харакеристистик. У звʼязку із цим автор запропонував власне бачення на структуру криміналістичної характеристики ухилення від сплати податків, зборів (обовʼязкових платежів) як кримінального правопорушення у сфері господарської діяльності.
